Terms and Conditions The following are the Terms and Conditions. By visiting or by using busneeds.com you expressly agree to abide by the terms mentioned below. Busneeds.com reserves the right to amend the Terms and Conditions at any time. Visitors to Busneeds.com are required to be bound by the Terms. Violations to Terms and Conditions will lead to civil and criminal proceedings. Definitions Customer refers to any individual or business entity or non business entity using the site to find or reserve transportation, lodging and entertainment sources. Service Provider refers to any business entity advertising on Busneeds.com or the company Busneeds.com contract with to provide the requested service. Busneeds.com refers to the web site in its entirety and its related or affiliated sites owned by Busneeds.com Payment Payment can be made through credit cards, checks and pay pal. A 20% deposit is required for all transportation services. Cancellation made within 30 days to the trip will lead to total charges by Busneeds.com. A 5% fee will be added to the payment made by credit cards and pay pal. Release of Liability Busneeds.com, its employees, successors, shareholders, affiliates, Subsidiaries, officers, directors, agents and assigns do not own or operate any equipment or Service Provider which provides or is to provide services for your trip. The Customers (for itself and on behalf of the Passengers) hereby expressly agrees that Busneeds.com shall not be responsible in any manner for the acts or failures to act, negligently, willfully or otherwise, of the service provider or its employees, agents or representatives. Customers (for itself and on behalf of the Passengers) also expressly agrees that Busneeds.com shall not be liable for any bodily injury or harm, accident, property damage or Personal loss as a result of the Transportation Services provided by the Service Provider. To the fullest extent permitted by law, and not withstanding any other provision of this Agreement, The Customers and its passengers agree, in consideration for the services provided by Busneeds.com, to indemnify and hold Busneeds.com harmless from any and all damages, injuries, claims and causes of action, of any type or kind, whether or not caused in whole or in part by the negligence of Busneeds.com, its employees, agents or representatives. The Customer (for itself and on behalf of its passengers) hereby expressly agrees that If any portion of the Service Contract, including the terms of the Limitation of Liability paragraph or this paragraph, is found to be void or unenforceable, the remaining portion of this contract shall remain in full LIMITATION OF LIABILITY: NEITHER BUSNEEDS.COM, NOR THE SERVICE PROVIDER, SHALL BE LIABLE IN ANY EVENT OR FOR ANY REASON, INCLUDING BREACH OF THIS AGREEMENT, EITHER DIRECTLY OR INDIRECTLY, TO THE OTHER PARTY OR ANY THIRD PARTY FOR ANY SPECIAL, INDIRECT, INCIDENTAL, PUNITIVE, EXEMPLARY OR CONSEQUENTIAL DAMAGES OR LOSS OF PROFITS ARISING OUT OF THIS AGREEMENT, EVEN IF SUCH DAMAGES WERE FORESEEABLE OR THE COMPANY OR THE SERVICE PROVIDER HAS BEEN ADVISED OF THE POSIIBILITY OF SUCH DAMAGES. IT IS EXPRESSLY AGREED THAT NEITHER THE COMAPNY, NOR THE SERVICE PROVIDER, SHALL, UNDER ANY CIRCUMSTANCES, BE LIABLE TO ANY PARTY FOR AN AMOUNT GREATER THAN THE SINGLE BUS CHARTER FEE FOR THE DAY IN QUESTION. INDEMNIFICATION BY THE CHARTERING PARTY: The Customers shall indemnify and hold harmless Busneeds.com and the Service Provider and their respective affiliates, officers, directors, employees and agents harmless from and against any claims, lawsuits, proceedings, liabilities, damages expenses (including reasonable attorney´s fees) and/or costs arising out of or related to the negligence of the Customer or arising out of or related to an occurrence or accident involving Busneeds.com chartered equipment and/or the transportation of passengers in such equipment (including damages to the equipment and injury to any Passenger or other third person arising from the transportation of any weapon, explosive, fireworks, oxygen, or other flammable, combustible, toxic or otherwise dangerous materials or items or pets or livestock by any Passenger). Disclaimers FORCE MAJEURE: Busneeds.com and the Service Provider shall not be liable for any failure or delay in performing their obligations under the Service Contract, and neither party shall be deemed in breach of its obligations there under, if such failure or delay is due to Acts of God, natural disasters, national, local and local states of emergency, acts of war or terrorism, labor strike or lock-out, or other industrial and transportation accident caused by any third party, any violation of law, regulation or ordinance by any third party or any other cause not within the control of Busneeds.com or the Service Provider, respectively. GOVERNING LAW: This agreement and its performance shall be governed by the laws of the state of New Jersey, USA without giving effects to applicable conflict of law provisions. Busneeds.com (for itself and on behalf of the Passengers) consents and submits to the exclusive jurisdiction of the state and federal courts located in Middlesex county, the State of New Jersey, United States of America, in all questions and controversies arising out of this agreement. PROHIBITED ITEMS: The following items and activities are prohibited without the written consent of the company: (i) decorations, (2) alcoholic beverages (a fee, per bus may be require if alcoholic beverages are allowed by the Company and Service Provider) (3) smoking (4) glass containers (5) golf shoes or other shoes with spikes (6) generators or non medical oxygen containers. Tap beer is not allowed on any bus. PROHIBITION OF WEAPONS, EXPLOSIVES, OXYGEN, PETS, and LIVESTOCK AND OTHER DANGEROUS OR UNUSUAL CARGO: Weapons of any type, including firearms, are strictly forbidden on any equipment (whether in baggage or on the person) at any time. Transportation of explosives, fireworks and other flammable, combustible, toxic or otherwise dangerous materials or items or pets or livestock of any kind are also strictly forbidden, even if intended to be transported in the baggage compartment of the equipment. If previously approved by the Service Provider, oxygen for medical use is permitted, but is so used at the sole responsibility of the Chartering Party. CONDUCT OF PASSENGERS: Passengers shall not interfere with the operator in the discharge of his/ her duty or tamper with any apparatus or appliance on the bus. OBJECTINABLE PERSONS: Busneeds.com and its Service Providers reserve the right to refuse to transport the persons under the influence of intoxicating liquor or drugs, or who are or likely to become objectionable to other persons or if the driver feels threaten in any way. ARBITRATION: In the event a dispute shall arise between the parties to this agreement, it is hereby agreed that the dispute shall be referred to the American Arbitration Association for three-person arbitration in accordance with its applicable rules of arbitration. The arbitrators´ decision shall be final and legally binding and judgment may be entered thereon. Each party shall be responsible for its share of the arbitration fees. In the event a party fails to proceed with arbitration, unsuccessfully challenges the arbitrators´ awards or fails to comply with the arbitrators. award, the other party is entitled to costs of suit including a reasonable attorney´s fee for having to compel arbitration or defend or enforce the award. ARRIVAL TIME: The time of arrival at starting point, stopover point, destination or return to point of origin cannot be guaranteed. Travel speed limits are prescribed by law, and Service Providers are instructed to travel at all times at speeds compatible with safe operation. Road, traffic and weather conditions are beyond the control of Busneeds.com and the Service Provider, and no refunds shall be given as a result of late arrivals due to such conditions or other occurrences out of the control of Busneeds.com or the Service Provider CANCELLATION POLICY: For sedans, cancellation made 24 hrs prior to the trip will be charged the total fare. For motor coaches, party buses, mini buses, vans and stretch limousines, cancellation made within 30 days to the trip will be charged the total fare. All hourly trips are calculated from our from our Service Provider´s garage to garage. For overnight trips, the Chartering Party must provide accommodation for driver(s). We will not be liable to any trip interruption because of mechanical failures, traffic congestion.
